PLEASE READ THE FOLLOWING IMPORTANT PROVISIONS

All tickets are issued and conveyance undertaken in accordance with the following conditions of carriage and subject to the exclusion of liability contained herein :

1. THE CARRIER: The carrier is Luxliner Coaches (Pty) Ltd, with limited liability duly incorporated in accordance with the Company Laws of the Republic of South Africa, trading as Luxliner and having as its principal of business at 6 Dunswart Avenue, Dunswart;

2. TICKETS: Tickets are not transferable and are valid only for the journey specified on the ticket. A valid ticket must be displayed by the passenger on entering the Luxliner coach. Lost or stolen tickets may be replaced at the sole discretion of Luxliner. It is the sole responsibility of the passenger to ensure that the correct information is contained on the ticket; Any alteration to a ticket will render it invalid. Any change requires that a replacement ticket be issued.

3. FARES: All fares are subject to change without notice. Luxliner will only be bound by the fares charge upon purchase of tickets.

4. RIGHT OF ADMISSION: Luxliner reserves the right of admission to any of its coaches or buses.

5. DEPARTURE TIME: Passengers must be at the departure points no later than 30 (thirty) minutes before departure time reflected on the ticket. A passenger arriving later than 10 (ten) minutes before the departure time reflected on the ticket, will waive his right to such a ticket and such a ticket will be made available to standby passengers on a first come first serve basis.

6. PAYMENTS, CANCELLATIONS AND REFUNDS: Tickets must be paid for on departure of coach, at the latest. Regrettably no payment by cheque will be accepted. Cancellations must be made at the agency at which the ticket was issued, or, if unable to do so, at any Luxliner Reservations office, or any Computicket outlet. Any appointment agency may, at its own discretion, levy a cancellation fee. No cancellation fees will be levied up to 24 hours before departure. Cancellations within 24 hours of departure: a levy will be charged. Please contact Luxliner booking office for more detail. Should a passenger not advise any of the above agencies of cancellation fore the time of departure and obtain a cancellation reference number, no refund will be given. If a passenger misses the coach departure, and still wants to travel, he/she must contact a Luxliner booking office, who will transfer the ticket to the next departure, depending on the availability of seats. A levy will be charged for cancellation of credit card bookings. Contact Luxliner booking office for more details. In the event of any request for a refund, the original ticket purchased must accompany such request. Special requests for refunds must be made, in writing and accompanied by the original ticket and supporting documents to: Luxliner Intercity Coaches, Refunds, PO Box 6283, Dunswart, 1508. Such refunds will be at the sole discretion of Luxliner.

7. LUGGAGE: Each fare-paying passenger is permitted to take, free of charge and at own risk, one item of personal luggage not exceeding 80cm x 60cm x 30cm in size, of total mass not exceeding 30kg. Luxliner reserves the right to refuse the carriage of any item or luggage which does not comply with these conditions at its own discretion. Passengers should obtain a Luxliner luggage sticker when boarding. Unaccompanied luggage will not be carried. Luxliner is not responsible whatsoever for loss or damage to passengers' luggage, hand luggage or personal effects, property or luggage. All passengers should ensure that their luggage is adequately insured. The carrying of firearms is not permitted on Luxliner coaches. Harmful chemicals, explosives, or toxic substances will not be carried. No bicycles, electronic equipment, fishing rods, surfboards, abnormal boxes, or perishables will be carried.

8. SMOKING: Smoking is prohibited on all the coaches.

9. ALCOHOL: Luxliner reserves the right to refuse the consumption of alcohol on its coaches, or not to undertake the conveyance of any passenger who enters the coach whilst intoxicated.

10. PETS: No animals will be carried, with the exception of a trained guide dog accompanying a blind passenger.

11. CHILDREN: No children under the age of 12 years will be conveyed without being accompanied by an adult. Children 12 years and older pay scholar rates. Children 02-11 years pay 50% of standard adult rate. (Limit of 3 per adult fare-paying passenger). Children younger than 02 years travel free if not occupying a seat. Should more than one child under two years old accompany the same adult, all successive children will pay the rates for 02-11 year old category. Positive identification will be a requirement when ticket is collected.

12. SCHEDULES / TIMETABLES: Whilst Luxliner will make all reasonable effort to keep to the scheduled timetable, no liability whatsoever can be accepted by Luxliner for any loss or damage incurred by any passenger, or inconvenience experienced by any person due to a delay, curtailment or cancellation of any service for whatsoever reason; Luxliner reserves the right to substitute coaches with those of a different standard or modification to those advertised under circumstances such as mechanical breakdowns and the like.

14. DISCLAIMER: Luxliner, its Directors, Officers, Employees, Servants or Agents shall not be liable (whether in contract or delict) in any way whatsoever for any loss, injury, loss of life, or damage of whatsoever nature and howsoever caused, whether or not caused by the negligence of Luxliner, its Directors, Officers, Employees, Servants or Agents, arising out of or connected in any way to the conveyance or non-conveyance by Luxliner of any passenger or any person or of the property of any person whether such property is accompanied by a passenger or not.
